Minister Edukacji Narodowej i Sportu Rzeczypospolitej Polskiej i Ministerstwo Edukacji, Kultury i Nauki Mongolii, zwani dalej „Stronami", popierając dalszy rozwój współpracy i wymiany doświadczeń w dziedzinie oświaty i szkolnictwa wyższego, stosownie do artykułu 14 Umowy między Rządem Rzeczypospolitej Polskiej a Rządem Mongolii o współpracy w dziedzinie kultury, oświaty i nauki, podpisanej w Warszawie dnia 9 grudnia 1999 r.,

uzgodniły, co następuje:

Artykuł 1

1. Strona polska każdego roku będzie przyjmować:

1) 10 osób na jednolite studia magisterskie w państwowych szkołach wyższych,

2) 2 osoby na studia doktoranckie w państwowych szkołach wyższych.

2. Strona polska zapewni bezpłatną naukę i odpłatne zakwaterowanie w domach akademickich.

3. Strona mongolska wypłaci świadczenia stypendialne obejmujące koszty utrzymania i zakwaterowania.

Artykuł 2

Strona polska umożliwi studentom i doktorantom mongolskim, przyjętym na studia w polskich szkołach wyższych na podstawie wcześniej podpisanych porozumień, kontynuację studiów na warunkach określonych w tych porozumieniach.

Artykuł 3

1. Strona polska będzie przyjmować co roku, na okres łącznie do 30 miesięcy, do 10 specjalistów mongolskich, którzy ukończyli studia w polskich szkołach wyższych, na staże naukowe w tych uczelniach.

2. Strona polska zapewni bezpłatną naukę i odpłatne zakwaterowanie w domach akademickich.

3. Strona mongolska będzie pokrywać koszty ich pobytu w Polsce.

Artykuł 4

1. Strona mongolska każdego roku będzie przyjmować:

1) do 8 osób (młodych pracowników naukowo-dydaktycznych państwowych szkół wyższych i studentów ostatnich lat) w celu odbywania stażu i badań naukowych na okres łącznie do 40 miesięcy,

2) do 8 osób na staże językowe i studia częściowe w zakresie języka mongolskiego na okres łącznie do 32 miesięcy.

2. Strona mongolska zapewni bezpłatną naukę i odpłatne zakwaterowanie w domach akademickich.

3. Strona polska wypłaci świadczenia stypendialne.

Artykuł 5

Strony będą wymieniać specjalistów z dziedziny oświaty i szkolnictwa wyższego do 4 osób na okres do 2 tygodni. Koszty pobytu i podróży pokrywa Strona wysyłająca.

Artykuł 6

Strony będą przyjmować, bez pobierania opłat za naukę, dzieci pracowników placówek dyplomatycznych i konsularnych do publicznych szkół podstawowych i gimnazjów.

Artykuł 7

1. Strona wysyłająca kandydatów na jednolite studia magisterskie będzie przekazywać dokumenty kandydatów Stronie przyjmującej do końca marca, a dokumenty kandydatów na studia doktoranckie do końca stycznia każdego roku.

2. Warunkiem przyjęcia na niektóre kierunki studiów, wymagające szczególnych predyspozycji (na przykład artystyczne, medyczne lub na studia w akademiach wychowania fizycznego), jest zdanie egzaminów w kraju Strony przyjmującej potwierdzających predyspozycje kandydata do podjęcia tych studiów. W takich przypadkach ostateczna decyzja o przyjęciu kandydata na wybrany kierunek studiów zapadnie po zdaniu egzaminu.

Artykuł 8

Strona wysyłająca kandydatów w ramach artykułu 3 i 4 niniejszego programu będzie przekazywać dokumenty kandydatów Stronie przyjmującej na 2 miesiące przed proponowanym terminem realizacji pobytu. Przyjazd może nastąpić po otrzymaniu zgody Strony przyjmującej.

Artykuł 9

Strona wysyłająca zapewni, że osoby uczestniczące w wymianie objętej programem będą posiadały ubezpieczenie (polisę) na wypadek nagłych zachorowań lub nieszczęśliwego wypadku, chyba że prawo do świadczeń zdrowotnych wynika z przepisów kraju przyjmującego.

Artykuł 10

Program nie wyklucza realizacji innych przedsięwzięć, jeśli zostaną one uzgodnione przez obie Strony.

Artykuł 11

Program wchodzi w życie w dniu podpisania i będzie obowiązywał do dnia 31 grudnia 2005 roku.

Sporządzono w Warszawie dnia 15 maja 2003 r., w dwóch jednobrzmiących (oryginalnych) egzemplarzach, każdy w językach polskim, mongolskim i angielskim, przy czym wszystkie teksty mają jednakową moc. W przypadku rozbieżności przy ich interpretacji tekst w języku angielskim będzie decydujący.

CO-OPERATION PROGRAMME

between the Minister of National Education and Sport of the Republic of Poland and the Ministry of Education, Culture and Science of Mongolia for the years 2003 – 2005

The Minister of National Education and Sport of the Republic of Poland and the Ministry of Education, Culture and Science of Mongolia, hereinafter called the "Parties", supporting the further development of co-operation and exchange of experience in the field of education and higher education, pursuant to article 14 of the Agreement between the Government of the Republic of Poland and the Government of Mongolia in the Field of Culture, Education and Science, signed in Warsaw on 9 December 1999,

have agreed as follows:

Article 1

1. The Polish Party shall accept each year:

1) 10 persons for uniform master degree studies in state institutions of higher education,

2) 2 persons for doctoral studies in state institutions of higher education.

2. The Polish Party shall provide education free of charge and accommodation in student dormitories at a charge.

3. The Mongolian Party shall pay scholarships covering accommodation and living expenses.

Article 2

The Polish Party shall enable Mongolian students and doctoral course students accepted for studies in Polish institutions of higher education on the basis of previously signed agreements to continue their studies under the terms and conditions specified in these agreements.

Article 3

1. The Polish Party shall accept each year, for a total period of up to 30 months, up to 10 Mongolian specialists who have graduated from Polish institutions of higher education, for to take part in an assistantships in these higher education institutions.

2. The Polish Party shall provide education free of charge and accommodation in student dormitories at a charge.

3. The Mongolian Party shall cover the costs of their stay in Poland.

Article 4

1. The Mongolian Party shall accept each year:

1) up to 8 persons (young academic staff from institutions of higher education and students completing their final years of studies) to carry out the assistantships and scientific research for a total period of up to 40 months.

2) up to 8 persons for language courses and patrial studies in the Mongolian language for a total period of up to 32 months.

2. The Mongolian Party shall provide education free of charge and accommodation in student dormitories at a charge.

3. The Polish Party shall pay scholarships.

Article 5

The Parties shall exchange up to 4 specialists from the field of education and higher education for a period of up to 2 weeks. The costs of the stay and travel shall be covered by the sending Party.

Article 6

The Parties shall accept, without collecting charges for education, the children of employees of diplomatic and consular posts to public primary and lower secondary schools.

Article 7

1.The Party sending candidates for uniform master degree studies shall convey the documents of the candidates to the accepting Party by the end of March, and the documents of candidates for doctoral studies by the end of January each year.

2. A condition for acceptance to certain academic specialisations which require special predispositions (for example, artistic profiles, medical studies and in academies of physical education) shall be passing the exams in the country of the accepting Party, confirming the predispositions of the candidate to undertake these studies. In such cases, the final decision to accept the candidate for the chosen field of studies shall be made after passing the examination.

Article 8

The Party sending candidates under articles 3 and 4 of this Programme shall convey the documents of the candidates to the accepting Party 2 months before the proposed period of the stay. Arrival may take place after the consent of the accepting Party has been obtained.

Article 9

The sending Party shall ensure that the persons taking part in the exchange under this Programme have health and accident insurance, in the event of sudden illness or accident, unless the right to health benefits is stipulated in the regulations of the accepting Party.

Article 10

The Programme shall not exclude the realisation of other ventures if they are agreed upon by both Parties.

Article 11

The Programme shall come into force on the day of signing and shall remain in effect until 31 December 2005.

Done in Warsaw, on (date) May 15, 2003, in two original copies, each in the Polish, Mongolian and English languages, all texts being equally binding. In case of differences in interpretation, the English text shall prevail.
