UMOWA

między Rządem Rzeczypospolitej Polskiej a Rządem Mongolii o współpracy w dziedzinie kultury, oświaty i nauki

Rząd Rzeczypospolitej Polskiej i Rząd Mongolii, zwane dalej Stronami,

pragnąc przyczyniać się do dalszego rozwoju współpracy w dziedzinie kultury, oświaty i nauki między obu krajami,

przekonane, że współpraca taka sprzyja lepszemu zrozumieniu i poznaniu między narodami obu krajów,

uzgodniły, co następuje:

Artykuł 1

Strony będą popierać dalszy rozwój współpracy w dziedzinie kultury i sztuki, oświaty, nauki, środków masowego przekazu, ochrony zdrowia, sportu i turystyki.

Artykuł 2

W celu upowszechniania znajomości kultury i sztuki drugiego kraju Strony będą popierać:

a) nawiązywanie kontaktów między zainteresowanymi instytucjami kulturalnymi i artystycznymi oraz wymianę wizyt pisarzy i artystów, w tym artystów amatorów,

b) organizowanie wystaw artystycznych, imprez muzycznych, wymianę zespołów artystycznych, wystawianie sztuk teatralnych,

c) wymianę programów radiowych i telewizyjnych oraz organizowanie przeglądów filmów na warunkach handlowych i niekomercyjnych,

d) współpracę między bibliotekami, muzeami i innymi instytucjami kulturalnymi oraz wymianę kaset audio-video, książek, filmów, prasy,

e) współpracę między wydawnictwami, promocję książek oraz ich sprzedaż,

f) wspólne organizowanie przedsięwzięć kulturalnych na wcześniej uzgodnione tematy,

g) tłumaczenie najlepszych prac naukowych oraz dzieł literatury pięknej.

Artykuł 3

Strony będą popierać współpracę między instytucjami zajmującymi się restauracją zabytków historii i sztuki.

Artykuł 4

Każda ze Stron uzna prawa autorskie i prawa pokrewne przysługujące osobom fizycznym i prawnym drugiej Strony oraz ich prawnym następcom i będzie gwarantować ochronę tych praw, opierając się na zasadach wynikających ze standardów ochrony określonych w Porozumieniu w sprawie handlowych aspektów praw własności intelektualnej TRIPS, stanowiącym załącznik do Porozumienia ustanawiającego Światową Organizację Handlu (WTO).

Szczegółowe warunki i tryb takiej ochrony będą ustalone w oddzielnym porozumieniu między Stronami.

Artykuł 5

Strony będą popierać dalszy rozwój współpracy i wymianę doświadczeń w dziedzinie oświaty i szkolnictwa wyższego, a w szczególności:

a) wymianę nauczycieli akademickich w celu prowadzenia prac naukowo-badawczych oraz stażystów,

b) nawiązywanie bezpośrednich kontaktów między instytucjami oświatowymi różnych szczebli,

c) wymianę studentów i doktorantów,

d) wymianę literatury specjalistycznej, programów nauczania, materiałów dydaktycznych i pomocy naukowych,

e) upowszechnianie literatury i nauki języków obu krajów,

f) wymianę młodzieży, w tym uczniów i studentów, w celu uczestnictwa w przedsięwzięciach organizowanych w obu krajach.

Artykuł 6

Strony podejmą prace zmierzające do uzgodnienia projektu umowy o wzajemnym uznawaniu świadectw szkolnych, dyplomów ukończenia studiów wyższych i dokumentów o nadaniu stopni naukowych i tytułów naukowych. Do czasu zawarcia umowy podstawę prawną uznawania dokumentów o wykształceniu, stopniach naukowych i tytułach naukowych wydawanych w Rzeczypospolitej Polskiej i w Mongolii stanowić będzie Konwencja o wzajemnym uznawaniu równoważności dokumentów ukończenia szkół średnich, szkół średnich zawodowych i szkół wyższych, a także dokumentów o nadawaniu stopni i tytułów naukowych, podpisana w Pradze dnia 7 czerwca 1972 r.

Artykuł 7

Strony będą popierać dalszy rozwój współpracy między akademiami nauk, archiwami oraz innymi instytucjami naukowymi obu krajów.

Artykuł 8

Strony będą popierać wymianę informacji na temat planowanych imprez kulturalnych, naukowych, sportowych oraz wzajemne zapraszanie swoich przedstawicieli do udziału w tych imprezach.

Artykuł 9

Strony będą popierać współpracę w dziedzinie kultury, oświaty i nauki w ramach UNESCO i innych organizacji międzynarodowych.

Artykuł 10

Strony będą popierać współpracę w dziedzinie kultury fizycznej, sportu i turystyki.

Artykuł 11

Strony będą popierać bezpośrednią współpracę między Towarzystwami Polsko-Mongolskim i Mongolsko-Polskim, a także między stowarzyszeniami artystów, architektów, kompozytorów, filmowców, pisarzy i dziennikarzy obu krajów.

Artykuł 12

Strony będą popierać współpracę między agencjami informacyjnymi, w tym wymianę dziennikarzy oraz wysyłanie korespondentów.

Artykuł 13

Strony będą popierać współpracę w dziedzinie ochrony zdrowia realizowaną na podstawie bezpośrednich porozumień między zainteresowanymi instytucjami obu krajów.

Artykuł 14

W celu realizacji niniejszej umowy będą zawierane okresowe programy współpracy na szczeblu rządowym i/lub resortowym, w których będą uzgadniane konkretne przedsięwzięcia i warunki finansowe.

Artykuł 15

Niniejsza umowa podlega przyjęciu zgodnie z prawem każdej ze Stron i wejdzie w życie w dniu otrzymania późniejszej noty potwierdzającej to przyjęcie.

Artykuł 16

Niniejsza umowa zawarta jest na okres pięciu lat. Ulega ona automatycznemu przedłużeniu na dalsze pięcioletnie okresy, jeżeli żadna ze Stron nie wypowie jej w drodze notyfikacji na sześć miesięcy przed upływem danego okresu.

W przypadku wypowiedzenia niniejszej umowy wszystkie programy i porozumienia podpisane na jej podstawie zachowają moc do końca okresu ich obowiązywania.

Sporządzono w Warszawie dnia 9 grudnia 1999 r. w dwóch egzemplarzach, każdy w językach polskim, mongolskim i angielskim, przy czym wszystkie teksty mają jednakową moc. W przypadku rozbieżności w interpretacji tekst w języku angielskim będzie decydujący.

AGREEMENT

between the Government of the Republic of Poland and the Government of Mongolia on co-operation in the field of culture, education and science

The Government of the Republic of Poland and the Government of Mongolia, hereinafter called the Parties,

in the desire to contribute to the further development of co-operation in the field of culture, education and science between the two countries,

convinced that such co-operation promotes better understanding and cognition between the nations of the two countries,

have agreed as follows:

Article 1

The Parties shall encourage the further development of co-operation in the filed of culture and art, education, science, mass media, health protection, sports and tourism.

Article 2

In order to spread the knowledge of culture and art of the other country, the Parties shall promote:

a) contacts between interested cultural and artistic institutions and exchange of visits by writers and artists, including amateur artists,

b) organisation of artistic exhibitions, musical events, exchange of artistic troupes, theatre performances,

c) exchange of radio and television programmes and organising commercial and non-commercial film reviews,

d) co-operation between libraries, museums and other cultural institutions and exchange of audio and video tapes, books, films, press,

e) co-operation between publishing houses, promotion of books and sales thereof,

f) joint organisation of cultural events on previously, agreed subjects,

g) translation of best scientific papers and works of literature.

Article 3

The Parties shall promote co-operation between institutions dealing with renovation of historic monuments and works of art.

Article 4

Each of the Parties shall recognise copy rights and related rights held by the other Party's citizens and institutions and their legal successors, and shall guarantee the protection of these rights, based on principles and standards of protection, as defined in the TRIPS Agreement which constitutes an annex to the Founding Agreement of the World Trade Organization (WTO).

Detailed conditions and means of such protection shall be defined in a separate agreement between the Parties.

Article 5

The Parties shall encourage the further development of co-operation and exchange of experience in the field of education and higher education, and in particular:

a) exchange of academic teachers with the aim to conduct scientific research, and of trainees,

b) making direct contacts between educational institutions at various levels,

c) exchange of students and postgraduate students,

d) exchange of professional literature, teaching curricula, didactic materials and teaching aids,

e) dissemination of literature and promotion of the teaching of the languages of the two countries.

f) exchange of youth, including pupils and students, to allow their participation in events organised in the two countries.

Article 6

The Parties shall commence work leading to drafting an agreement on mutual recognition of school certificates, diplomas of higher education and documents granting academic degrees and academic titles. By the time the agreement is concluded, the legal basis for recognition of documents of education, academic degrees and academic titles issued in the Republic of Poland and in Mongolia, shall be the Convention on mutual recognition of equivalence of documents of secondary education, secondary professional education and higher education, as well as documents granting academic degrees and titles, signed in Prague on June 7, 1972.

Article 7

The Parties shall promote further development of co-operation between academies of sciences, archives and other scientific institutions of the two countries.

Article 8

The Parties shall support exchange of information concerning intended cultural, scientific and sports events, and mutual invitations of their respective representatives to participate in these events.

Article 9

The Parties shall promote co-operation in the field of culture, education and science within the framework of UNESCO and other international organisations.

Article 10

The Parties shall encourage co-operation in the field of physical culture, sports and tourism.

Article 11

The Parties shall promote direct co-operation between the Polish-Mongolian and Mongolian-Polish Societies respectively, and also between associations of artists, architects, composers, film makers, writers and journalists of the two countries.

Article 12

The Parties shall promote co-operation between information agencies, including exchange of journalists and dispatch of correspondents.

Article 13

The Parties shall encourage co-operation in the field of health protection, implemented on the basis of direct agreements between interested institutions of the two countries.

Article 14

With a view to implementing this Agreement, temporary co-operation programmes shall be concluded at governmental and/or ministerial level, where concrete ventures and financial terms and conditions shall be provided.

Article 15

This Agreement shall be adopted in accordance with the law of each of the Parties and shall enter into force on the day of reception of a note confirming such an adoption.

Article 16

This Agreement is concluded for the period of five years. It shall be automatically prolonged for further five-year periods, unless terminated by any of the Parties by way of notification six months before the conclusion of a given period.

In the event of termination of this Agreement, all programmes and agreements signed on the basis thereof shall remain in force until the end of the binding period.

Done in Warsaw on this 9^th day of December 1999 in two copies, each in the Polish, Mongolian and English languages, all texts being equally binding. In case of differences of interpretation, the English text shall prevail.
