PROTOKÓŁ DODATKOWY Nr 12

do Środkowoeuropejskiej umowy o wolnym handlu (CEFTA)

Przedstawiciele Republiki Bułgarii, Republiki Czeskiej, Republiki Węgierskiej, Rzeczypospolitej Polskiej, Rumunii, Republiki Słowackiej i Republiki Słowenii (zwanych dalej „Stronami”),

potwierdzając swoje oddanie zasadom gospodarki rynkowej, stanowiącej podstawę ich stosunków, odwołując się do swych intencji stopniowego wyeliminowania przeszkód w ich całym wzajemnym handlu,

zgodnie z postanowieniami artykułów 34, 35, 37 i 39 Środkowoeuropejskiej umowy o wolnym handlu,

postanawiają, co następuje:

Artykuł 1

Załącznik C i D do Protokołu 11 Środkowoeuropejskiej umowy o wolnym handlu tracą moc i zostają zastąpione nowymi Załącznikami C i D do Protokołu 11, które stanowią integralną część niniejszego Protokołu dodatkowego.

Artykuł 2

Niniejszy Protokół dodatkowy stanowi integralną część Środkowoeuropejskiej umowy o wolnym handlu.

Artykuł 3

1. Niniejszy Protokół dodatkowy wejdzie w życie sześćdziesiątego dnia od daty otrzymania przez depozytariusza ostatniej notyfikacji Stron o zakończeniu procedur koniecznych do tego celu.

2. Depozytariusz notyfikuje wszystkim Stronom zakończenie procedur koniecznych do wejścia w życie niniejszego Protokołu dodatkowego.

3. Jeśli niniejszy Protokół dodatkowy nie wejdzie w życie do dnia 1 stycznia 2003 r., to będzie on stosowany prowizorycznie między Republiką Czeską a Republiką Słowenii i między Republiką Słowacką a Republiką Słowenii od tej daty.

NA DOWÓD CZEGO, niżej podpisani pełnomocnicy, będąc należycie upełnomocnieni, podpisali niniejszy Protokół dodatkowy.

SPORZĄDZONO w Zagrzebiu dnia 5 grudnia 2002 r. w jednym oryginalnym egzemplarzu w języku angielskim, który będzie zdeponowany przy Rządzie Rzeczypospolitej Polskiej. Depozytariusz przekaże poświadczone kopie niniejszego Protokołu dodatkowego wszystkim Stronom Środkowoeuropejskiej umowy o wolnym handlu.

ADDITIONAL PROTOCOL No. 12

to the Central European Free Trade Agreement

Representatives of the Republic of Bulgaria, the Czech Republic, the Republic of Hungary, the Republic of Poland, Romania, the Slovak Republic and the Republic of Slovenia (hereinafter called the Parties);

Reaffirming their commitment to the principles of a market economy, which constitutes the basis for their relations,

Recalling their intention to eliminate progressively the obstacles to substantially all their mutual trade,

In accordance with the provisions of Articles 34, 35, 37 and 39 of the Central European Free Trade Agreement,

Have decided as follows:

Article 1

Annexes C and D to the Protocol 11 to the Central European Free Trade Agreement shall be abolished and replaced with new Annexes C and D to the Protocol 11, which shall constitute an integral part of this Additional Protocol.

Article 2

This Additional Protocol shall constitute an integral part of the Central European Free Trade Agreement.

Article 3

1. This Additional Protocol shall enter into force on the sixtieth day from the date of receiving by the Depositary of the last notification of the Parties of the completion of procedures necessary for that purpose.

2. The Depositary shall notify all Parties of the completion of procedures necessary for the entry into force of this Additional Protocol.

3. If this Additional Protocol does not enter into force by 1 January 2003 it shall be applied provisionally between the Czech Republic and the Republic of Slovenia and between the Slovak Republic and the Republic of Slovenia from that date.

IN WITNESS WHEREOF the undersigned plenipotentiaries being duly authorised thereto, have signed this Additional Protocol.

DONE at Zagreb this 5 day of December 2002 in a single authentic copy in the English language, which shall be deposited with the Government of the Republic of Poland. The Depositary shall transmit certified copies of this Additional Protocol to all Parties to the Central European Free Trade Agreement.
