PROGRAM

współpracy między Rządem Rzeczypospolitej Polskiej a Rządem Republiki Słowenii w dziedzinie kultury, nauki i oświaty na lata 2003–2006

Rząd Rzeczypospolitej Polskiej i Rząd Republiki Słowenii, zwane dalej „Stronami”,

– kierując się postanowieniami artykułu 20 Umowy między Rządem Rzeczypospolitej Polskiej i Rządem Republiki Słowenii o współpracy w dziedzinach oświaty, kultury i nauki, podpisanej w Warszawie dnia 14 lutego 1994 r.,

– dążąc do rozszerzenia wymiany w dziedzinach kultury, nauki i oświaty,

uzgodniły, co następuje:

I. Kultura i sztuka

Artykuł 1

Strony, w okresie obowiązywania Programu, wymienią po jednej wystawie sztuki współczesnej z uwzględnieniem zainteresowania drugiej Strony.

Wybór wystawy powinien być dokonany na podstawie zgłoszenia z 12-miesięcznym wyprzedzeniem przed planowanym otwarciem ekspozycji.

Artykuł 2

Strony będą popierały bezpośrednią współpracę między związkami twórczymi, organizacjami i instytucjami kultury obu krajów.

Strony będą wspierały wymianę twórców, artystów i ekspertów w dziedzinie kultury na wizyty studyjne na okres nie dłuższy niż 30 dni dla każdej ze Stron, w ramach programów rocznych instytucji kulturalnych, stowarzyszeń i organizacji.

Artykuł 3

Strony będą popierały bezpośrednią współpracę między muzeami i galeriami sztuki, w tym wymianę ekspertów oraz współpracę w zakresie zachowania dziedzictwa kulturalnego między instytucjami zajmującymi się ochroną i konserwacją zabytków.

Artykuł 4

Strony będą popierały wymianę doświadczeń dotyczących tworzenia prawa regulującego ochronę dóbr kultury, a w szczególności zwalczania nielegalnego wywozu dzieł sztuki zgodnie z „Konwencją dotyczącą środków zmierzających do zakazu i zapobiegania nielegalnemu przywozowi, wywozowi i przenoszeniu własności dóbr kultury”, sporządzoną w Paryżu dnia 17 listopada 1970 r.

Artykuł 5

Strony będą kontynuowały współpracę w dziedzinie archiwistyki między Naczelną Dyrekcją Archiwów Państwowych Rzeczypospolitej Polskiej a Archiwum Republiki Słowenii w oparciu o bezpośrednie „Porozumienie o współpracy między Naczelnym Dyrektorem Archiwów Państwowych Rzeczypospolitej Polskiej a Archiwum Republiki Słowenii”, zawarte 9 października 1998 r.

W celu realizacji tej współpracy Strony zagwarantują wymianę ekspertów, na zasadzie wzajemności, w okresie dziesięciu dni roboczych rocznie.

Współpraca ta będzie obejmowała także realizację międzynarodowego projektu „Wspólne dziedzictwo archiwalne Europy Środkowej i Wschodniej”.

Artykuł 6

Strony będą popierały współpracę między teatrami, stowarzyszeniami teatralnymi, scenami operowymi oraz w dziedzinie baletu przez:

a) wymianę zaproszeń na festiwale teatralne, operowe i baletowe,

b) wymianę tekstów sztuk teatralnych,

c) wymianę taśm wideo z przedstawieniami teatralnymi.

Artykuł 7

Strony będą popierały współpracę między Biblioteką Narodową w Warszawie a Narodową Biblioteką Uniwersytetu w Lublanie i innymi polskimi i słoweńskimi bibliotekami w zakresie: wymiany książek, czasopism, materiałów audiowizualnych, wydawnictw własnych, a w szczególności z zakresu bibliografii narodowych.

Strony wyrażają zainteresowanie nawiązaniem współpracy w zakresie organizowania wspólnych wystaw.

Strony będą również popierały współpracę między bibliotekami publicznymi i naukowymi oraz wymianę ekspertów i doświadczeń w wykorzystaniu nowych technik bibliotekarskich.

Artykuł 8

Strony będą organizowały staże dla polskich i słoweńskich tłumaczy literatury pięknej.

Artykuł 9

Strony będą wzajemnie informowały się o najważniejszych targach książki, takich jak Międzynarodowe Targi Książki w Warszawie i Targi Książki w Lublanie.

Artykuł 10

Strony będą popierały bezpośrednią współpracę między instytucjami, organizacjami i twórcami filmowymi obu krajów. Będą również sprzyjały prezentacji filmów drugiego kraju w ramach międzynarodowych festiwali filmowych organizowanych w swoim kraju zgodnie z regulaminami poszczególnych festiwali.

Strony będą sprzyjały, na zasadzie wzajemności, organizowaniu niekomercyjnych przeglądów filmów.

Artykuł 11

Strony będą popierały współpracę w dziedzinie twórczości ludowej oraz wymianę zespołów artystycznych i folklorystycznych w ramach międzynarodowych festiwali, znaczących imprez kulturalnych lub na zaproszenie drugiej Strony.

Szczegóły dotyczące wymiany (wybór zespołu, określenie repertuaru, programu pobytu i terminu wizyty) będą ustalane drogą bezpośrednich kontaktów na zasadach wzajemności.

Artykuł 12

Strony, po ustaleniu warunków bezpośrednio z organizatorami, zapewnią udział swoich artystów i twórców w realizacji następujących projektów:

1. w Polsce:

a) uczestnictwo obserwatorów w Warszawskich Spotkaniach Teatralnych,

b) udział teatru słoweńskiego w Międzynarodowym Festiwalu Teatralnym Kontakt w Toruniu lub Międzynarodowym Festiwalu Teatralnym Malta w Poznaniu,

c) udział wykonawców i obserwatorów w festiwalach muzycznych: Międzynarodowym Festiwalu Warszawska Jesień i Międzynarodowym Festiwalu Wratislavia Cantans,

d) udział pisarzy słoweńskich w imprezach literackich o charakterze międzynarodowym,

e) udział tłumaczy słoweńskich w Światowym Kongresie Tłumaczy Literatury Polskiej;

2. w Słowenii:

a) udział polskich grafików w Międzynarodowym Biennale Grafiki,

b) udział polskiego autora w dorocznym spotkaniu PEN-Club w BIed,

c) udział polskiego autora w spotkaniu autorów z krajów Europy Środkowej Vilenica,

d) udział polskich muzyków w Festiwalu Muzyki Kameralnej XX wieku w Radencach lub w festiwalu Brežice.

Artykuł 13

Strony udzielą wsparcia wystawie Tadeusz Kantor: jego teatr i malarstwo, która zostanie zorganizowana w Lublanie (Słowenia) w 2004 r. w ramach współpracy Ośrodka Dokumentacji Sztuki Tadeusza Kantora „Cricoteka” w Krakowie z Narodowym Muzeum Teatralnym.

Artykuł 14

Strony udzielą wsparcia wystawie poświęconej twórczości Jože Plečnika, którą zorganizuje Międzynarodowe Centrum Kultury w Krakowie w 2004 r.

II. Oświata i nauka

Artykuł 15

Strony będą dążyły do pogłębienia i rozszerzenia współpracy w dziedzinie edukacji. W tym celu Ministerstwo Edukacji Narodowej i Sportu Rzeczypospolitej Polskiej oraz Ministerstwo Szkolnictwa, Nauki i Sportu Republiki Słowenii uzgodnią priorytetowe obszary współpracy w dziedzinie edukacji oraz podejmą konkretne kroki zachęcające do bezpośrednich kontaktów między szkołami wszystkich szczebli i innymi instytucjami oświatowymi oraz do wymiany informacji i specjalistów.

Artykuł 16

Strony, w miarę potrzeb i wspólnych obszarów zainteresowań, wymienią delegacje odpowiednich instytucji w celu zapoznania się z systemami edukacji w obu krajach.

Artykuł 17

Strony uznają znaczenie rzetelnego przedstawiania historii i geografii każdego z krajów w podręcznikach szkolnych. W tym celu rozważą możliwość powołania dwustronnej komisji polskich i słoweńskich specjalistów do przeprowadzenia analizy programów nauczania historii i geografii.

Artykuł 18

Strony będą wspierały bezpośrednią współpracę między szkołami wyższymi obu krajów, w tym zawieranie umów, zwłaszcza między Uniwersytetem Warszawskim, Uniwersytetem Łódzkim, Uniwersytetem im. Adama Mickiewicza w Poznaniu oraz Uniwersytetem Śląskim w Katowicach a Uniwersytetem w Lublanie, Uniwersytetem w Mariborze oraz innymi instytucjami szkolnictwa wyższego w Słowenii.

Artykuł 19

Strony będą wspierały współpracę bibliotek Instytutu Slawistyki Polskiej Akademii Nauk w Warszawie i w Krakowie z Biblioteką Wydziału Slawistyki Fakultetu Nauk Humanistycznych w Lublanie.

Artykuł 20

Strony wysoko oceniają prowadzenie studiów słowenistycznych w polskich szkołach wyższych i nadal będą wspierały lektoraty języka słoweńskiego na Uniwersytecie Jagiellońskim w Krakowie, Uniwersytecie Warszawskim, Uniwersytecie Śląskim w Katowicach i Uniwersytecie Łódzkim oraz lektoraty języka polskiego na Uniwersytecie w Lublanie poprzez udzielanie pomocy w zatrudnianiu lektorów.

Strony w pełni popierają starania Uniwersytetu w Lublanie zmierzające do przygotowania i utworzenia kierunku studiów polonistycznych.

Artykuł 21

1. Strony będą corocznie wymieniać 3 studentów – na studia roczne lub semestralne (łącznie do 30 miesięcy), zwłaszcza studentów polonistyki i słowenistyki.

2. Strony corocznie będą dokonywały wymiany wykładowców szkół wyższych oraz studentów polonistyki i słowenistyki na wakacyjne kursy językowe – po 5 osób każda ze Stron.

3. Strony będą corocznie wymieniały – w limicie do 16 miesięcy rocznie – studentów i pracowników naukowych z drugiego kraju na staże naukowe trwające od 1 do 9 miesięcy.

Artykuł 22

Strony będą popierały bezpośrednią współpracę szkół i uczelni artystycznych obu krajów, w tym:

a) wymianę grup uczniowskich i studenckich, a także kadry pedagogicznej,

b) wymianę przedstawicieli uczelni artystycznych w konferencjach, seminariach, kolokwiach, sesjach dotyczących kształcenia artystycznego i teorii sztuki organizowanych przez drugą Stronę,

c) wymianę informacji o programach nauczania i podręcznikach systemu szkolnictwa artystycznego,

d) współpracę w zakresie pomocy dydaktycznych i naukowych.

Warunki finansowe współpracy będą uzgadniane bezpośrednio przez zainteresowane instytucje.

Artykuł 23

Strony będą wspierały rozwój współpracy między Polską Akademią Nauk w Warszawie a Słoweńską Akademią Nauk w Lublanie, realizowanej na podstawie bezpośredniego porozumienia o współpracy naukowej, podpisanego w 1994 r.

Strony będą rozszerzały i pogłębiały bezpośrednią współpracę między placówkami naukowymi, jednostkami badawczo-rozwojowymi oraz instytucjami prowadzącymi badania naukowe, a także między naukowcami obu krajów.

Artykuł 24

Strony będą popierały wspólne starania Instytutu Badań Literackich Polskiej Akademii Nauk w Warszawie i Wydziału Slawistyki Uniwersytetu w Lublanie przygotowania projektu w zakresie badań porównawczych nad literaturą oraz kulturą słoweńską i polską, który ma być prowadzony w ramach współpracy bezpośredniej.

III. Inne dziedziny współpracy

Artykuł 25

Strony uznają prawa autorskie i pokrewne do utworów, przysługujące obywatelom i instytucjom drugiego państwa oraz ich następcom prawnym, niezależnie od miejsca pierwszego opublikowania tych utworów.

Strony zapewnią ochronę praw autorskich na takich samych warunkach, jakie gwarantuje ich prawo wewnętrzne dla ich własnych obywateli i instytucji.

Strony zobowiązują się ponadto do poszanowania praw autorskich i pokrewnych swoich obywateli, zgodnie ze standardami obowiązującymi w Unii Europejskiej.

Artykuł 26

Strony będą popierały bezpośrednią współpracę młodzieży obu krajów w zakresie wymiany między Szkołami oraz inne formy współpracy młodzieżowej, w tym wymianę między organizacjami młodzieżowymi.

Strony będą popierały współpracę między organizacjami kultury fizycznej i sportu oraz sprzyjały wszelkim inicjatywom służącym dalszemu jej rozwijaniu.

Artykuł 27

Radiofonie obu krajów będą nadal ściśle współpracowały w ramach członkostwa w Europejskiej Unii Radiowej (EBU).

Artykuł 28

Strony będą popierały bezpośrednią współpracę telewizji polskiej (Telewizja Polska SA) z telewizją słoweńską (Televizija Slovenija) w ramach obowiązującej umowy dwustronnej.

Artykuł 29

Strony będą popierały bezpośrednią współpracę między komitetami narodowymi do spraw Organizacji Narodów Zjednoczonych do spraw Edukacji, Nauki i Kultury (UNESCO).

IV. Postanowienia ogólne i finansowe

Artykuł 30

Strona wysyłająca przekaże Stronie przyjmującej propozycje dotyczące wymiany specjalistów, co najmniej trzy miesiące przed proponowanym terminem wizyty.

Strona przyjmująca powiadomi Stronę wysyłającą o swej decyzji co do przyjęcia kandydatów, co najmniej sześć tygodni przed planowanym rozpoczęciem pobytu.

Strona wysyłająca poinformuje Stronę przyjmującą o dokładnej dacie przyjazdu specjalistów i środkach lokomocji najpóźniej trzy tygodnie przed przyjazdem.

Powyższe terminy mogą być zmienione po wzajemnym uzgodnieniu między instytucjami realizującymi wymianę.

Artykuł 31

Strona wysyłająca przekaże Stronie przyjmującej do dnia 30 marca każdego roku dokumentację kandydatów na studia, kursy językowe i staże naukowe, o których mowa w artykule 21 Programu.

Kandydaci zostaną wybrani przez wspólną komisję, składającą się z przedstawicieli Strony wysyłającej i Ambasady państwa Strony przyjmującej.

Dokumentacja kandydatów na studia i staże naukowe powinna zawierać: życiorys, świadectwo zdrowia, potwierdzenie znajomości języków obcych niezbędnych dla podjęcia studiów lub stażu, plan studiów lub stażu (z zaznaczeniem instytucji i specjalistów, z którymi kandydat zamierza współpracować), a w przypadku pracowników naukowych – także kopię dyplomu lub zaświadczenia o stopniu naukowym.

Strona przyjmująca powiadomi Stronę wysyłającą o swych decyzjach dotyczących zakwalifikowania kandydatów na kursy letnie nie później niż do dnia 1 czerwca każdego roku, a na studia i staże – nie później niż 3 miesiące przed przewidywanym terminem ich rozpoczęcia.

Artykuł 32

Strona wysyłająca pokrywa koszty podróży do miejsca docelowego w kraju przyjmującym i z powrotem.

Artykuł 33

Strona wysyłająca zapewni, że osoby uczestniczące w wymianie objętej Programem będą posiadały ubezpieczenie na wypadek choroby lub nieszczęśliwego wypadku.

Artykuł 34

Strona przyjmująca pokrywa koszty podróży na jej terytorium wynikające z uzgodnionego programu pobytu.

Artykuł 35

Strona przyjmująca zapewnia osobom przybywającym na wizyty studyjne na okres do 30 dni, o których mowa w artykule 2, oraz komisarzom wystaw bezpłatne zakwaterowanie, bezpłatne wyżywienie lub diety pobytowe zgodnie z przepisami Strony przyjmującej.

Artykuł 36

Osobom, o których mowa w artykule 21 ustęp 1 i ustęp 3 Programu, Strona przyjmująca zapewnia bezpłatną naukę lub realizację programu naukowego w publicznych szkołach wyższych oraz zapewni świadczenia stypendialne zgodnie z odpowiednimi przepisami wewnętrznymi każdej ze Stron.

Artykuł 37

Uczestnikom językowych kursów letnich, o których mowa w artykule 21 ustęp 2, Strona przyjmująca pokrywa koszty pobytu zgodnie z jej przepisami wewnętrznymi.

Artykuł 38

Szkoły wyższe Strony przyjmującej zapewnią lektorom kierowanym w ramach artykułu 21 wynagrodzenie zgodnie z jej przepisami wewnętrznymi oraz bezpłatne, odpowiednie, samodzielne zakwaterowanie.

Stosunki pracy tych osób podlegają przepisom prawa, w tym również w zakresie ubezpieczenia zdrowotnego, obowiązującym w państwie Strony przyjmującej.

Artykuł 39

Strona wysyłająca pokrywa koszty transportu wystawy do pierwszego miejsca ekspozycji w kraju przyjmującym oraz koszty transportu powrotnego wystawy. Koszty transportu wystawy do innych miejsc ekspozycji na swoim terytorium pokrywa Strona przyjmująca.

Artykuł 40

Strona wysyłająca pokrywa koszty ubezpieczenia wystawy na czas transportu i ekspozycji. W przypadku zniszczenia lub uszkodzenia eksponatów, Strona przyjmująca zobowiązana jest przekazać Stronie wysyłającej niezbędną dokumentację dotyczącą szkód w celu umożliwienia uzyskania odszkodowania z tytułu ubezpieczenia. Koszty przygotowania i przesłania dokumentacji pokrywa Strona przyjmująca wystawę.

Strona przyjmująca nie może podejmować żadnych napraw uszkodzonych eksponatów bez zgody Strony wysyłającej.

Artykuł 41

Strona przyjmująca pokrywa koszty organizacji wystawy, zapewniając odpowiednio wyposażone sale wystawowe, reklamę oraz druk katalogu, do którego niezbędne materiały będą dostarczone co najmniej trzy miesiące przed datą otwarcia.

Artykuł 42

W przypadku wystaw muzealnych odpowiednie instytucje obu Stron mogą uzgodnić w bezpośrednim porozumieniu specjalne warunki dla ich organizacji.

V. Postanowienia końcowe

Artykuł 43

Wszelkie kwestie sporne, które mogą wyniknąć podczas realizacji Programu, będą rozstrzygane w drodze dyplomatycznej.

Artykuł 44

Niniejszy Program nie wyklucza realizacji innych porozumień w dziedzinie kultury, nauki i edukacji, zawieranych bezpośrednio między zainteresowanymi instytucjami.

Artykuł 45

Niniejszy Program wejdzie w życie w dniu podpisania i pozostanie w mocy do dnia 31 grudnia 2006 r. Jego obowiązywanie zostanie automatycznie przedłużone do czasu podpisania kolejnego Programu, o ile żadna ze Stron nie wypowie go w drodze notyfikacji. W takim przypadku Program utraci moc obowiązującą w terminie 60 dni od dnia wypowiedzenia.

Sporządzono w Warszawie dnia 9 kwietnia 2003 r., w dwóch oryginalnych egzemplarzach, każdy w języku: polskim, słoweńskim i angielskim. Wszystkie teksty są jednakowo autentyczne. W razie rozbieżności tekst w języku angielskim będzie uważany za rozstrzygający.

PROGRAMME

of cooperation between the Government of the Republic of Poland and the Government of the Republic of Slovenia in the Field of Culture, Science and Education in the Years 2003–2006

The Government of the Republic of Poland and the Government of the Republic of Slovenia, hereinafter referred to as "the Parties",

– pursuant to the provisions of article 20 of the Agreement between the Government of the Republic of Poland and the Government of the Republic of Slovenia on cooperation in the fields of education, culture and science, signed in Warsaw on February 14, 1994,

– seeking to expand cooperation in the fields of culture, science and education,

have agreed as follows:

I. Culture and Art

Article 1

Under this Programme, the Parties shall exchange one modern art exhibition each guided by the wishes of the other Party.

The selection of the exhibition shall be made on the basis of an application submitted 12 months before the planned opening of the exhibition.

Article 2

The Parties shall promote direct cooperation between artistic associations, organisations and cultural institutions of the two countries.

The Parties shall support exchanges of authors, artists and cultural experts, taking the form of study visits, with stays of up to thirty days for each Party within annual programme of cultural institutions, associations or organisations.

Article 3

The Parties shall support direct cooperation between museums and art galleries, including exchange of experts and cooperation in the field of preservation of the cultural heritage between institutions involved in the protection and conservation of cultural monuments.

Article 4

The Parties shall support exchange of experiences pertaining to domestic legislation concerning the protection of cultural values, with particular regard to combating illegal trafficking in works of art as envisaged in "The Convention on Means of Prohibiting and Preventing Illicit Import, Export and Transfer of Ownership of Cultural Property", signed in Paris on November 17, 1970.

Article 5

The Parties shall continue cooperation in the field of archives between the Head Office of State Archives of the Republic of Poland and the Archive of the Republic of Slovenia, on the basis of the "Agreement on cooperation between the General Director of State Archives of the Republic of Poland and the Archive of the Republic of Slovenia", concluded on October 9, 1998.

To implement this cooperation, the Parties shall exchange experts for stays lasting ten working days each year.

The cooperation shall also include implementation of the international project "Common archive heritage of Central and Eastern Europe".

Article 6

The Parties shall support collaboration between theaters, drama associations, operas and ballets through:

a) exchange of invitations to drama, opera and ballet festivals,

b) exchange of theater play scripts,

c) exchange of videos with theater productions.

Article 7

The Parties shall promote cooperation between the National Library in Warsaw and the National and University Library in Ljubljana and other Polish and Slovene libraries in the fields of: exchanging books, periodicals, audio-visual materials and own publications, with particular regard to national bibliographies.

The Parties express their interest in joint organisation of library exhibitions.

The Parties shall also support cooperation between public and scientific libraries, and shall promote exchange of experts and experience on the application of new librarianship technologies.

Article 8

The Parties shall organize internships for Polish and SIovene translators of literature.

Article 9

The Parties shall inform each other on most important book fairs, such as the International Book Fair in Warsaw and Book Fair in Ljubljana.

Artice 10

The Parties shall promote direct cooperation between filmmakers, as well as their institutions and organisations in the two countries. They shall also facilitate presentation of films of the other side at international film festivals in their countries, in accordance with the rules of such festivals.

The Parties shall promote the organisation, on reciprocal basis, of non-commercial film reviews.

Article 11

The Parties shall support collaboration in the field of folk art and the exchange of artistic ensembles, in the framework of international festivals, major cultural events, or at the invitation of the other Party.

The particulars concerning the exchanges (choice of the ensemble, elaboration of the repertoire, programme and date of visit) shall be determined through direct contacts on reciprocal basis.

Article 12

The Parties shall establish directly with project organisers participation conditions for the two countries' artists and authors and shall make sure that they take part in the following projects:

1. In Poland:

a) participation of observers in the Warsaw Theatre Meetings,

b) participation of a Slovene theatre in the International Theatre Festival Kontakt in Toruń, or the International Theatre Festival Malta in Poznań,

c) participation of performers and observers in music festivals: the International Warsaw Autumn Festival and the Wratislavia Cantans International Festival,

d) participation of Slovene writers in international literary events,

e) participation of Slovene translators in the World Congress of Translators of Polish Literature.

2. In Slovenia:

a) participation of Polish graphic artists in the International Biennale of Graphic Art,

b) participation of a Polish author in the annual meeting of the PEN-Club in Bled,

c) participation of a Polish author in the International Writer's Gathering Vilenica,

d) participation of Polish musicians in the Festival of 20^th Century Chamber Music in Radenci or the Brežice Festival.

Article 13

The Parties shall grant support to the exhibition Tadeusz Kantor: His Theatre and Painting in Ljubljana/Slovenia as cooperation between Cricoteka, Centre for the Documentation of the Art of Tadeusz Kantor, Cracow and the National Theatre Museum from Ljubljana in the year 2004.

Article 14

The Parties shall grant support to the exhibition devoted to the works of Jože Plečnik, to be organised by the International Culture Center in Cracow, in 2004.

II. Education and Science

Article 15

The Parties shall seek to develop their cooperation in education. For this purpose, the Ministry of National Education and Sport of the Republic of Poland and the Ministry of Education, Science and Sport of the Republic of Slovenia, shall determine cooperation priorities in the field of education, and shall take concrete steps to encourage direct contacts between schools at all levels and other educational institutions and exchange of information and specialists.

Article 16

The Parties shall where necessary and on the basis of mutual interest exchange delegations between relevant institutions to become acquainted with the system of education in the other country.

Article 17

The Parties recognise the significance of accurate presentation of the history and geography of each country in school textbooks. For this purpose, the Parties shall consider the establishment of a bilateral commission of Polish and Slovene specialists to analyse history and geography curricula.

Article 18

The Parties shall promote direct cooperation between institutions of higher education of the two countries and conclusion of agreements, particularly between Warsaw University, Łódź University, Adam Mickiewicz University in Poznań, Silesian University in Katowice and University of Ljubljana, University of Maribor and other higher education institutions in Slovenia.

Article 19

The Parties shall support cooperation of the libraries of the Slavonic Studies Institute of Polish Academy of Sciences in Warsaw and Cracow with the library of the Slavonic Department at the Faculty of Arts at the University of Ljubljana.

Article 20

The Parties positively asses Slovene studies in Polish higher schools and shall continue to support the Slovene language lectorate at Jagiellonian University in Cracow, Warsaw University, University of Silesia in Katowice and Łódź University and Polish language lectorate at the University of Ljubljana through providing assistance in employing lecturers there.

The Parties fully support the University of Ljubljana endeavours in preparing and implementing the programme of regular undergraduate Polish studies.

Article 21

1. The Parties shall receive each year 3 persons for yearly or semester studies (up to 30 months altogether), particularly students of the Polish and Slovene languages.

2. The Parties shall each year exchange lecturers and students of Polish and Slovene studies to attend summer language courses – 5 persons from each side.

3. The Parties shall each year exchange students and scientific workers for interships lasting from 1 do 9 months, their combined period of stay not exceeding 16 months annually.

Article 22

The Parties shall support direct collaboration between artistic schools in the two countries through:

a) exchange of school and university students and teaching staff,

b) participation of artistic school representatives in conferences, seminars and sessions concerning artistic education and artistic theory, organised by the other Party,

c) exchange of information on artistic education curricula and textbooks,

d) collaboration with regard to teaching aids.

The financial conditions of cooperation shall be determined directly by the interested institutions.

Article 23

The Parties shall support the development of cooperation between Polish Academy of Sciences in Warsaw and Slovene Academy of Sciences and Arts in Ljubljana, based on the direct agreement on scientific cooperation, signed in 1994.

The Parties shall develop direct cooperation between research institutions, research-and-development entities and other research organisations, as well as individual scientists of the two countries.

Article 24

The Parties shall support the joint preparation by the Institute of Literary Studies of Polish Academy of Sciences in Warsaw and the Slavonic Department of the University of Ljubljana, of the Polish and Slovene literature and culture comparative studies project, to be pursued within the framework of direct cooperation.

III. Other Fields of Cooperation

Article 25

Each Party shall recognize the copyrights and other related rights belonging to the physical and legal persons of the other Party and their legal successors, regardless of the place of first publication of the works in question.

The Parties shall ensure copyright protection on the same terms as provided in their domestic legislation for their own physical and legal persons.

The Parties shall ensure the protection of copyrights and related rights in accordance with European Union standards.

Article 26

The Parties shall support exchange of school youth and other forms of youth cooperation, including exchanges between youth organisations.

The Parties shall support cooperation between physical culture and sports organisations and favour all initiatives conducive to its further development.

Article 27

The radio broadcasting organisations of the two countries shall continue their collaboration as members of the European Broadcasting Union (EBU).

Article 28

The Parties shall support direct cooperation between Polish television (Telewizja Polska S.A.) and Slovene television (Televizija Slovenija), on the basis of the bilateral agreement in force.

Article 29

The Parties shall support cooperation between their national United Nations Educational, Scientific and Cultural Organization (UNESCO) committees.

IV. General and Financial Provisions

Article 30

The sending Party shall submit to the receiving Party its proposals concerning exchange of specialists at least three months in advance of the planned visit.

The receiving Party shall advise the sending Party of its decision at least six weeks in advance of the planned visit.

The sending Party shall advise the receiving Party of the precise date of arrival and mode of transport at least three weeks before arrival.

The above deadlines may be changed – by mutual consent – by the institutions involved in the exchange.

Article 31

The sending Party shall convey to the receiving Party, by March 30 of each year, documents pertaining to the candidates for studies, language courses and internships referred to in Artice 21 of this Programme.

The candidates shall be selected by a joint commission, including representatives of the sending Party and the Embassy of the receiving Party.

The documents pertaining to candidates for studies and internships shall include: the curriculum vitae of the candidate, health certificate, foreign language certificate, plan of studies or research (identifying the institutions and specialists with whom the candidate intends to collaborate). Scientific workers shall also submit copies of diplomas or scientific degree certificates.

The receiving Party shall notify the sending Party of its decisions concerning candidates approved for summer courses not later than by June 1^st each year, and for studies and internships – not later than three months before their initiation.

Article 32

The sending Party shall cover the costs of return travel to the place of destination in the host country.

Article 33

The sending Party shall ensure that exchange participants covered by this Programme have health and accident insurance.

Article 34

The receiving Party shall cover the costs of travel on its territory connected with the programme of the visit.

Article 35

The receiving Party shall provide participants in study visits lasting up to thirty days, referred to in Article 2, and exhibition commissioners free accommodation, free board or per diems in accordance with the domestic regulations of the receiving Party.

Article 36

The receiving Party shall provide for persons indicated in Article 21, paragraphs 1 and 3 of this Programme, tuition-free education or scientific programmes in state higher schools and provide scholarships according to relevant provisions of the internal legislation of each Party of this Programme.

Article 37

The receiving Party shall cover the costs of participation in summer language courses, referred to in Article 21 paragraph 2 of this Programme, in a manner consistent with its domestic regulations.

Article 38

The higher schools of the receiving Party shall provide lecturers delegated under Article 21 with salaries envisaged by local regulations and appropriate, free-of-charge, single-occupancy accommodation.

The terms of employment of those persons, including health insurance, shall comply with domestic regulations of the receiving Party.

Article 39

The sending Party shall cover the costs of transport of an exhibition to the first place of exposition in the host country and the costs of return transport. The receiving Party shall cover the transport costs to other places of exposition on its territory.

Article 40

The sending Party shall cover the insurance costs ot the exhibition during transport and exposition – according to the "nail to nail" principle. In the event of damage to the exhibits, the receiving Party shall supply the sending Party with the necessary documents for insurance claims. The costs of preparing and sending such documents shall be covered by the receiving Party.

The receiving Party shall not undertake any repairs of damaged exhibits without the consent of the sending Party.

Article 41

The receiving Party shall cover the costs of organising the exhibition, ensuring appropriate venue, publicity and printing of catalogue, the materials for which shall be supplied not later than three months before opening.

Article 42

In the case of museum exhibitions, the relevant institutions of the two Parties shall be able to directly elaborate special conditions of their organisation.

V. Final Provisions

Article 43

Any disputes arising during the implementation of this Programme shall be resolved through diplomatic channels.

Article 44

This Programme shall not prejudice the implementation of other agreements in the field of culture, science and education concluded directly by the interested institutions.

Article 45

This Programme shall come into force on the day of signing and shall remain in force until December 31, 2006. It shall be automatically extended until the signing of the next Programme, unless one of the Parties denounces it in writing. The Programme shall be terminated on the 60^th day after such notification.

Done at Warsaw this 9 day of April, 2003, in duplicate, in the Polish, Slovene and English languages, all texts being equally authentic. In the event of dispute in their interpretation, the English text shall prevail.
