W dniu 15 września 1999 r. został sporządzony w Pekinie Szósty protokół dodatkowy do Konstytucji Światowego Związku Pocztowego, sporządzonej w Wiedniu dnia 10 lipca 1964 r., w następującym brzmieniu:

Szósty protokół dodatkowy do Konstytucji Światowego Związku Pocztowego

Pełnomocnicy rządów krajów członkowskich Światowego Związku Pocztowego, zebrani na Kongresie w Pekinie, zgodnie z artykułem 30 ustęp 2 Konstytucji Światowego Związku Pocztowego, sporządzonej w Wiedniu dnia 10 lipca 1964 r., przyjęli, z zastrzeżeniem ratyfikacji, następujące zmiany do wymienionej konstytucji:

Artykuł l

(Artykuł 22 zmieniony)

Akty Związku

1. Konstytucja jest podstawowym aktem Związku. Zawiera ona zasadnicze przepisy Związku.

2. Regulamin generalny zawiera postanowienia zapewniające stosowanie Konstytucji i funkcjonowanie Związku. Obowiązuje on wszystkie kraje członkowskie.

3. Światowa Konwencja Pocztowa, Regulamin poczty listowej oraz Regulamin dotyczący paczek pocztowych zawierają wspólne przepisy dotyczące międzynarodowej służby pocztowej, jak również postanowienia dotyczące usług przesyłek listowych i usług paczek pocztowych. Akty te obowiązują wszystkie kraje członkowskie.

4. Porozumienia Związku i ich regulaminy regulują między krajami członkowskimi, które są ich stronami, usługi inne aniżeli te, które dotyczą przesyłek listowych i paczek pocztowych. Obowiązują one tylko te kraje.

5. Regulaminy określające środki, których stosowanie jest konieczne dla wykonania konwencji i porozumień, są uchwalane przez Radę Eksploatacji Pocztowej, zgodnie z decyzjami podjętymi przez Kongres.

6. Ewentualne protokoły końcowe załączone do aktów Związku wymienionych w ustępach 3, 4 i 5 zawierają zastrzeżenia do tych aktów.

Artykuł II

(Artykuł 25 zmieniony)

Podpisanie, uwierzytelnianie, ratyfikacja i inne sposoby zatwierdzania aktów Związku

1. Akty Związku przyjęte przez Kongres są podpisywane przez pełnomocników krajów członkowskich.

2. Regulaminy są uwierzytelniane przez Przewodniczącego i Sekretarza Generalnego Rady Eksploatacji Pocztowej.

3. Konstytucja jest ratyfikowana przez Kraje-Sygnatariuszy w możliwie najkrótszym terminie.

4. Zatwierdzanie aktów Związku innych niż Konstytucja następuje według postanowień konstytucyjnych poszczególnych Krajów-Sygnatariuszy.

5. Jeżeli jakiś kraj nie ratyfikuje Konstytucji lub nie zatwierdzi innych aktów podpisanych przez siebie, Konstytucja i inne akty zachowują pomimo to ważność dla krajów, które je ratyfikowały lub zatwierdziły.

Artykuł III

(Artykuł 29 zmieniony)

Zgłaszanie propozycji*

1. Administracja pocztowa** kraju członkowskiego ma prawo przedstawić bądź na Kongresie, bądź między dwoma Kongresami propozycje dotyczące aktów Związku, których jego kraj jest stroną.

2. Jednakże propozycje dotyczące Konstytucji i Regulaminu generalnego mogą być zgłaszane tylko na Kongresie.

3. Ponadto propozycje dotyczące regulaminów przedstawiane będą bezpośrednio Radzie Eksploatacji Pocztowej, z tym że wcześniej muszą zostać przekazane, za pośrednictwem Biura Międzynarodowego, administracjom pocztowym wszystkich krajów członkowskich.

Artykuł IV

Przystąpienie do Protokołu dodatkowego i do innych aktów Związku

1. Kraje członkowskie, które nie podpisały niniejszego protokołu, mogą do niego przystąpić w każdym czasie.

2. Kraje członkowskie, które są stronami aktów znowelizowanych przez Kongres, ale które ich nie podpisały, powinny do nich przystąpić w możliwie najkrótszym czasie.

3. Dokumenty przystąpienia odnoszące się do przypadków ujętych w ustępach 1 i 2 powinny być przekazane Dyrektorowi Generalnemu Biura Międzynarodowego, który notyfikuje rządom krajów członkowskich o ich złożeniu.

Artykuł V

Wejście w życie i okres obowiązywania Protokołu dodatkowego do Konstytucji Światowego Związku Pocztowego

Niniejszy protokół dodatkowy wejdzie w życie dnia 1 stycznia 2001 r. i pozostanie w mocy przez czas nieokreślony.

Na dowód czego pełnomocnicy rządów krajów członkowskich sporządzili niniejszy protokół dodatkowy, który mieć będzie taką samą moc i to samo znaczenie, jak gdyby jego postanowienia były zamieszczone w samym tekście Konstytucji, oraz podpisali go w jednym egzemplarzu, który zostanie złożony u Dyrektora Generalnego Biura Międzynarodowego. Jedna jego kopia doręczona zostanie każdej stronie przez rząd kraju, w którym odbył się Kongres.

* Wcześniej używano wyrażenia – „wnioski".

** Wcześniej używano „Zarządy pocztowe" od 1994 r. francuskie wyrażenie „administration postale" używane w różnych aktach UPU jest tłumaczone na język polski jako „administracja pocztowa".

Sixth Additional Protocol to the Constitution of the Universal Postal Union

The plenipotentiaries of the Governments of the member countries of the Universal Postal Union, met in Congress at Beijing, in view of article 30, paragraph 2, of the Constitution of the Universal Postal Union concluded at Vienna on 10 July 1964, have adopted, subject to ratification, the following amendments to that Constitution.

Article I

(Article 22 amended)

Acts of the Union

1. The Constitution shall be the basic Act of the Union. It shall contain the organic rules of the Union.

2. The General Regulations shall embody those provisions which ensure the application of the Constitution and the working of the Union. They shall be binding on all member countries.

3. The Universal Postal Convention, the Letter Post Regulations and the Parcel Post Regulations shall embody the rules applicable throughout the international postal service and the provisions concerning the letter-post and postal parcels services. These Acts shall be binding on all member countries.

4. The Agreements of the Union, and their Regulations, shall regulate the services other than those of the letter post and postal parcels between those member countries which are parties to them. They shall be binding on those countries only.

5. The Regulations, which shall contain the rules of application necessary for the implementation of the Convention and of the Agreements, shall be drawn up by the Postal Operations Council, bearing in mind the decisions taken by Congress.

6. The Final Protocols annexed to the Acts of the Union referred to in paragraphs 3, 4 and 5 shall contain the reservations to those Acts.

Article II

(Article 25 amended)

Signature, authentication, ratification and other forms of approval of the Acts of the Union

1. The Acts of the Union arising from the Congress shall be signed by the plenipotentiaries of the member countries.

2. The Regulations shall be authenticated by the Chairman and the Secretary-General of the Postal Operations Council.

3. The Constitution shall be ratified as soon as possible by the signatory countries.

4. Approval of the Acts of the Union other than the Constitution shall be governed by the constitutional regulations of each signatory country.

5. When a country does not ratify the Constitution or does not approve the other Acts which it has signed, the Constitution and other Acts shall be no less valid for the other countries that have ratified or approved them.

Article II

(Article 29 amended)

Presentation of proposals

1. The postal administration of a member country shall have the right to present, either to Congress or between Congresses, proposals concerning the Acts of the Union to which its country is a party.

2. However, proposals concerning the Constitution and the General Regulations may be submitted only to Congress.

3. Moreover, proposals concerning the Regulations shall be submitted direct to the Postal Operations Council but must first be transmitted by the International Bureau to the postal administrations of all member countries.

Article IV

Accession to the Additional Protocol and to the other Acts of the Union.

1. Member countries which have not signed the present Protocol may accede to it at any time.

2. Member countries which are party to the Acts renewed by Congress but which have not signed them shall accede thereto as soon as possible.

3. Instruments of accession relating to the cases set forth in paragraphs 1 and 2 shall be sent to the Director-General of the International Bureau, who shall notify the Governments of the member countries of their deposit.

Article V

Entry into force and duration of the Additional Protocol to the Constitution of the Universal Postal Union

This Additional Protocol shall come into force on 1 January 2001 and shall remain in force for an indefinite period.

In witness whereof the plenipotentiaries of the Governments of the member countries have drawn up this Additional Protocol, which shall have the same force and the same validity as if its provisions were inserted in the text of the Constitution itself, and they have signed it in a single original which shall be deposited with the Director-General of the International Bureau. A copy thereof shall be delivered to each party by the Government of the country in which Congress is held.

Sixième Protocole additionnel à la Constitution de l'Union postale universelle

Les Plénipotentiaires des Gouvernements des Pays-membres de l'Union postale universelle réunis en Congrès à Beijing, vu l'article 30, paragraphe 2, de la Constitution de l'Union postale universelle conclue à Vienne le 10 juillet 1964, ont adopté, sous réserve de ratification, les modifications suivantes à ladite Constitution.

Article l

Actes de l'Union

1. La Constitution est l'Acte fondamental de l'Union. Elle contient les règles organiques de l'Union.

2. Le Règlement général comporte les dispositions assurant l'application de la Constitution et le fonctionnement de l'Union. Il est obligatoire pour tous les Pays-membres.

3. La Convention postale universelle, le Règlement de la poste aux lettres et le Règlement concernant les colis postaux comportent les règles communes applicables au service postal international ainsi que les dispositions concernant les services de la poste aux lettres et des colis postaux. Ces Actes sont obligatoires pour tous les Pays-membres.

4. Les Arrangements de l'Union et leurs Règlements règlent les services autres que ceux de la poste aux lettres et des colis postaux entre les Pays-membres qui y sont parties. Ils ne sont obligatoires que pour ces pays.

5. Les Règlements, qui contiennent les mesures d'application nécessaires à l'exécution de la Convention et des Arrangements, sont arrêtés par le Conseil d'exploitation postale, compte tenu des décisions prises par le Congrès.

6. Les Protocoles finals éventuels annexés aux Actes de l'Union visés aux paragraphes 3, 4 et 5 contiennent les réserves à ces Actes.

Article II

Signature, authentification, ratification et autres modes d'approbation des Actes de l'Union

1. Les Actes de l'Union issus du Congrès sont signés par les plénipotentiaires des Pays-membres.

2. Les Règlements sont authentifiés par le Président et le Secrétaire général du Conseil d'exploitation postale.

3. La Constitution est ratifiée aussitôt que possible par les pays signataires.

4. L'approbation des Actes de l'Union autres que la Constitution est régie par les règles constitutionnelles de chaque pays signataire.

5. Lorsqu'un pays ne ratifie pas la Constitution ou n'approuve pas les autres Actes signés par lui, la Constitution et les autres Actes n'en sont pas moins valables pour les pays qui les ont ratifiés ou approuvés.

Article III

Présentation des propositions

1. L'administration postale d'un Pays-membre a le droit de présenter, soit au Congrès, soit entre deux Congrès, des propositions concernant les Actes de l'Union auxquels son pays est partie.

2. Toutefois, les propositions concernant la Constitution et le Règlement général ne peuvent être soumises qu'au Congrès.

3. En outre, les propositions concernant les Règlements sont soumises directement au Conseil d'exploitation postale, mais elles doivent être transmises au préalable par le Bureau international à toutes les administrations postales des Pays-membres.

Article IV

Adhésion au Protocole additionnel et aux autres Actes de l'Union

1. Les Pays-membres qui n'ont pas signé le présent Protocole peuvent y adhérer en tout temps.

2. Les Pays-membres qui sont parties aux Actes renouvelés par le Congrès mais qui ne les ont pas signés sont tenus d'y adhérer dans le plus bref délai possible.

3. Les instruments d'adhésion relatifs aux cas visés aux paragraphes 1 et 2 doivent être adressés au Directeur général du Bureau international. Celui-ci notifie ce dépôt aux Gouvernements des Pays-membres.

Article V

Mise à exécution et durée du Protocole additionnel à la Constitution de l'Union postale universelle

Le présent Protocole additionnel sera mis à exécution le 1^er janvier 2001 et demeurera en vigueur pendant un temps indéterminé.

En foi de quoi, les Plénipotentiaires des Gouvernements des Pays-membres ont dressé le présent Protocole additionnel, qui aura la même force et la même valeur que si ses dispositions étaient insérées dans le texte même de la Constitution, et ils l'ont signé en un exemplaire qui est déposé auprès du Directeur général du Bureau international. Une copie en sera remise à chaque Partie par le Gouvernement du pays siège du Congrès.

Fait à Beijing, le 15 septembre 1999.

Po zapoznaniu się z powyższym protokołem, w imieniu Rzeczypospolitej Polskiej oświadczam, że:

– został on uznany za słuszny zarówno w całości, jak i każde z postanowień w nim zawartych,

– jest przyjęty, ratyfikowany i potwierdzony,

– będzie niezmiennie zachowywany.

Na dowód czego wydany został akt niniejszy, opatrzony pieczęcią Rzeczypospolitej Polskiej.
